Maxxeshop Pty Ltd - Terms and Conditions of Sale

Welcome to Maxxeshop Pty Ltd. These Terms and Conditions ("Terms") govern the sale and supply of replacement aftermarket and genuine car and truck mirror assemblies, as well as replacement mirror glass ("Products") through our online store. By placing an order with us, you agree to be bound by these Terms.

1. Definitions

  • "We," "Us," "Our" refers to Maxxeshop Pty Ltd.
  • "You," "Your" refers to the customer or purchaser of our Products.
  • "Products" refers to the mirror assemblies and mirror glass offered for sale on our online store.

2. Order Acceptance

  • All orders are subject to acceptance by Maxxeshop Pty Ltd. We reserve the right to cancel or refuse any order for any reason prior to delivery.

3. Custom-Made Mirror Glass

3.1. Manufacturing to Order

  •   All replacement mirror glass is custom-made according to the specifications provided by you at the time of order. 

3.2. Refunds and Returns

  • Due to the custom-made nature of the mirror glass, refunds or exchanges are at the sole discretion of Maxxeshop Pty Ltd.
  • We are not obligated to provide a refund or replacement if you change your mind or make an incorrect selection.

3.3. Australian Consumer Law

  • This clause does not exclude, restrict, or modify any rights you have under the Australian Consumer Law ("ACL").
  • If the custom-made mirror glass is found to be defective or not of acceptable quality under the ACL, you may be entitled to a remedy.

4. Mirror Assemblies

4.1. Modifications and Customizations

  • If a mirror assembly is painted, modified, or customized at your request after or during purchase, it will be considered altered by you.

4.2. Refunds and Exchanges

  • Once a mirror assembly has been modified or customized, all rights to a refund, replacement, or exchange are withdrawn, except as provided under the ACL.
  • The modified or customized part will be deemed to have served its purpose as a new part and will be considered used or second-hand.

4.3. Australian Consumer Law

  • This clause does not exclude, restrict, or modify any rights you have under the ACL.
  • If the mirror assembly is found to be defective or not of acceptable quality under the ACL, you may be entitled to a remedy.

5. Pricing and Payment

5.1. Prices

  • All prices are listed in Australian Dollars (AUD) and include Goods and Services Tax (GST) unless stated otherwise.

5.2. Payment Terms

  • Payment must be made in full at the time of order through the payment methods specified on our website.

 6. Delivery

6.1. Shipping

  • We will make all reasonable efforts to deliver the Products within the estimated delivery timeframes.

6.2. Risk and Title

  • Risk in the Products passes to you upon delivery. Title passes upon full payment.

7. Warranty and Liability

7.1. Consumer Guarantees

  • Our goods come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

7.2. Limitation of Liability

  •   To the extent permitted by law, our liability is limited to the replacement or repair of the Products or the supply of equivalent Products.

8. Returns and Refunds

8.1. Change of Mind

  • We do not offer refunds or exchanges for change of mind purchases, especially for custom-made or modified Products.

8.2. Faulty Products

  • If you believe a Product is faulty, please contact us within 7 days of receipt. We may require proof of purchase and evidence of the fault.
  • Remedies will be provided in accordance with the ACL.

8.3 Purchase of Wrongly Chosen Items

  • If you have supplied Incorrect information when purchasing your item and the item dose not match that which was requested by you and detailed on your invoice, you must bring this to our attention within 14 days of delivery.
  • All incorrectly supplied items must be returned and received by us within 30 days of receipt if a refund or replacement is to be considered.
  • Items not return and receipted by us within the above time frames will be considered to still be in your posession and no refind or replacement will be offered.

9. Intellectual Property

  • All content on our website, including text, graphics, logos, and images, is the property of Maxxeshop Pty Ltd and is protected by intellectual property laws.

10. Privacy

  • We are committed to protecting your privacy. Our Privacy Policy, available on our website, explains how we collect, use, and disclose your personal information.

11. Governing Law

  • These Terms are governed by the laws of the State of Queensland, Australia. Any disputes arising from these Terms or your purchase will be resolved in the courts of that jurisdiction.

12. Amendments

  • Maxxeshop Pty Ltd reserves the right to amend these Terms at any time. Changes will be effective upon posting on our website.

Important Notice:

Nothing in these Terms is intended to exclude, restrict, or modify rights which you may have under the ACL or any other legislation which may not be excluded, restricted, or modified by agreement. Our goods come with guarantees that cannot be excluded under the ACL.

Custom-Made and Modified Products:

By purchasing custom-made mirror glass or requesting modifications to mirror assemblies, you acknowledge that these Products are tailored to your specifications. As such, refunds or exchanges are limited and are provided at our discretion, except where required under the ACL due to defects or failures.

By placing an order with Maxxeshop Pty Ltd, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
